Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of TashiOS, including tashios.com, your TashiOS Cloud Desktop, and related services. By signing up, starting a trial, or using TashiOS, you agree to these Terms and our Privacy Policy.

TashiOS is a subscription-based web operating system. We provide the platform, your dedicated server, and the tools to build and run your projects. You are responsible for how you use them.

2. Eligibility

You must be at least 18 years old and able to enter a binding contract. You must provide accurate account information and keep it up to date.

3. The Service

Depending on your plan, TashiOS may include:

A dedicated cloud server with the TashiOS operating system pre-installed
Your TashiOS Cloud Desktop, accessible from a modern web browser
AI-powered studios and tools, including Vibe Coding, WebDev, WP Developer, and Skynet
Built-in apps, file manager, terminal, and software updates
A monthly AI usage budget based on your plan, plus optional top-up credits
Access to the TashiOS App Store and Web Showcase to publish or sell your work
Optional programs such as CreatorsHub and the Affiliate Program, each with their own rules
Customer billing features that may connect to Stripe on your behalf
Email support (response times vary by plan)

Features may change over time as we improve TashiOS. We will not remove core functionality from paid plans without reasonable notice.

4. Free Trial

TashiOS offers a 7-day free trial of the Starter experience when available:

$0 is charged at signup. A valid payment method is required and stored securely by Stripe.
You receive the Starter server and features for 7 days, plus trial AI credits as shown at checkout (currently $150 in credits).
If you do not cancel before day 8, your subscription converts to Starter at the then-current price (currently $49/month) and your card is charged automatically. Your server continues without migration.
If you cancel before day 8, you are not charged. Your server is paused and kept for 14 days in case you reactivate. After 14 days, the server may be decommissioned and data deleted.
Unused trial AI credits do not expire and remain in your account if you convert to a paid plan.

Trial availability, credit amounts, and pricing are shown on the pricing page at the time you sign up.

5. Plans and Billing

Paid subscriptions are billed monthly through Stripe unless otherwise stated.
Prices, AI budgets, and plan limits are shown on tashios.com/pricing and may change for new signups. We will notify existing customers before price changes affect their renewal.
You may upgrade, downgrade, or cancel from the customer portal. Downgrades usually take effect at the next billing cycle. Upgrades may be prorated.
We do not refund partial months except where required by law or at our discretion.
AI top-up credits never expire and remain in your balance until used.
Failed payments may result in paused service until resolved.

6. AI Usage

Each plan includes a monthly AI budget. When your budget is used up, AI features pause until the budget resets on the 1st of the next month, or you purchase additional credits.

AI requests may be routed through TashiOS infrastructure for budget tracking and delivery to third-party AI providers. We do not store the content of your AI conversations for marketing or training purposes. See our Privacy Policy for details.

AI outputs are tools, not guarantees. You are responsible for reviewing anything you publish, sell, or deploy. TashiOS does not warrant that AI-generated code, copy, or designs are error-free, secure, or fit for a particular purpose.

7. Your Server and Your Content

Your TashiOS instance runs on a dedicated server assigned to your account. In normal operation:

We do not read your files, projects, or private conversations on your server
You own what you create: apps, websites, code, content, and data on your server
You may export your work at any time
We may access server metadata (status, version, hostname, resource use) to provide support, billing, security, and updates

You are responsible for backups, exports, and the legality of content you host or sell.

8. Marketplace, Billing, and Third Parties

If you list apps or sites on the TashiOS marketplace, publish to Web Showcase, join CreatorsHub, or bill your own customers:

You must comply with applicable laws, tax rules, and platform guidelines
You must not sell illegal, infringing, misleading, or harmful content
Customer payments may be processed by Stripe or other providers under their terms
TashiOS is not a party to transactions between you and your customers unless explicitly stated

Third-party services (hosting, Stripe, AI providers, domain registrars) have their own terms and may cause interruptions outside our control.

9. Acceptable Use

You agree not to:

Use TashiOS for illegal activity, fraud, spam, malware, or abuse
Attack, probe, or overload our systems or other users' servers
Circumvent AI limits, license checks, or security controls
Share login credentials or resell access without permission
Mine cryptocurrency or run sustained high-load workloads not intended for the service
Upload content that infringes intellectual property or privacy rights

We may suspend or terminate accounts that violate these rules.

10. Availability

We aim for reliable service but do not guarantee 100% uptime. Maintenance, provider outages, or force majeure may cause downtime. We will try to give notice for planned maintenance.

11. Cancellation and Termination

You may cancel anytime from your dashboard.

Paid plans: Access continues until the end of the current billing period. Export your data before access ends.
After cancellation: Your server may be decommissioned and data deleted after the grace period described at cancellation.
By us: We may suspend or terminate service for breach of these Terms, non-payment, or abuse, with notice where practical.

12. Intellectual Property

TashiOS software, branding, and documentation are proprietary. Your subscription grants you a limited, non-transferable license to use TashiOS while your account is active.

You retain ownership of what you build on your server. We do not claim ownership of your projects, subject to the license above and any separate marketplace terms you accept.

13. Disclaimer

TashiOS is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the fullest extent permitted by law, TashiOS is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption. Our total liability for any claim relating to the service is limited to the fees you paid to TashiOS in the three months before the event giving rise to the claim.

15. Changes

We may update these Terms. Material changes will be communicated by email or in-product notice. Continued use after the effective date means you accept the updated Terms.
